Frequently asked questions

Insurance Law & Claims Disputes: key answers

My Casco insurer denied my claim citing an exclusion. What can I do?

Denial based on exclusion clauses must be analyzed against the specific policy wording and the evidence on file. In practice, many invoked exclusions are open to interpretation (road conditions, weather, driver qualification). Standard steps: written request for detailed reasoning, independent technical expertise, administrative appeal to the insurer, ASF complaint for unfair practices and, if necessary, court action to compel payment.

How does an ASF complaint against an insurer work in Romania?

A complaint to ASF (Romanian Financial Supervisory Authority) is free and can be filed online or on paper. ASF can sanction the insurer for breaches of Law 132/2017, Law 237/2015 or sector-specific regulations. ASF cannot order the insurer to pay compensation in an individual case. Recovering the money requires court action. However, an ASF complaint is useful evidence of repeated abusive behavior in subsequent litigation.

What is the statute of limitations for insurance disputes in Romania?

The general term is 2 years from the occurrence of the insured event, under the Civil Code for actions derived from the insurance contract (Art. 2519). For tort liability actions, the term is 3 years. Special terms apply for life and transport insurance. Interrupting prescription through written notice to the insurer or through court action is essential to preserve the right.

When do you recommend D&O insurance to Romanian companies?

Directors & Officers insurance covers personal liability of board members and senior management for decisions taken in office: patrimonial liability claims, administrative sanctions or shareholder disputes. We recommend D&O coverage for: companies with external shareholders or foreign investors, listed companies or those preparing for listing, groups undergoing restructuring, and directors taking mandates with significant exposure. Careful review of exclusions (fraud carve-out, insolvency exclusion) is critical.
