Frequently asked questions
The challenge deadline is 15 days from the communication of the contravention report. The complaint is filed with the local court (judecătoria) where the contravention occurred. Filing within the deadline suspends enforcement of the sanction. Failure to challenge in time renders the report final and enforceable.
Outcomes depend on the evidence in the file and procedural compliance. The report can be annulled if: the agent did not clearly indicate the offense and the violated article, evidence is insufficient, the sanction is disproportionate, or the offender's rights were breached (no interpreter, no right to defense). In practice, a significant share of reports contain procedural defects that lead to annulment.
Yes. Government Ordinance 2/2001 allows payment of half the minimum fine if made within 15 days of communication, except in cases where special legislation excludes this reduction (for example, certain serious traffic offenses). Paying the reduced amount does not prevent challenging the report. You still have 15 days to file a complaint, and if the challenge succeeds, the amount is refunded.
Yes. Penalty points are cleared automatically 6 months after the last contravention sanction, provided no new points have been accumulated in between. License suspension is a distinct complementary sanction, which can be challenged together with the report or separately. Full license reinstatement may require medical and psychological re-examination.
