Frequently asked questions
Under the Romanian Code of Civil Procedure, enforcement titles include: final court judgments, arbitration awards, payment orders, notarized contracts containing executory clauses, bank loan and leasing contracts, promissory notes and bills of exchange, judgments rendered in other EU member states under European regulations. Without an enforcement title, one must first be obtained through court action or payment order procedure.
Effective recovery ranges from 3–6 months (simple cases with clearly identified assets: bank account garnishment, vehicles) to 2–5 years (real estate execution, enforcement challenges, multiple debtors or insolvency situations). The bailiff has strict legal deadlines: asset identification within 30 days, capitalization within maximum 1 year for real estate. Effectiveness depends significantly on initial strategy and on instituting precautionary measures before enforcement.
Seizable: salaries (within 1/3 or 1/2 for maintenance claims), bank accounts, real estate, vehicles, valuable movables, third-party claims, social rights. Exempt (Civil Procedure Code, Art. 727 et seq.): personal use items, food, winter fuel, tools necessary for the profession, the primary residence under certain conditions for claims under 70,000 RON, pensions below a certain threshold. Establishing the exact scope of seizable assets is essential for an effective strategy.
Defense tools are: enforcement challenge (within 15 days of communication of the contested act, fast-track procedure before the local court of the bailiff's seat), challenge to the title (against the enforcement title itself), suspension of enforcement through security deposit, complaint against bailiff refusal. Common winning grounds: prescription of enforcement, void or voidable enforcement title, enforcement initiated beyond the 3-year deadline from the title, procedural defects. Reacting within deadlines is critical. The deadlines are forfeitable.
