Frequently asked questions
Yes. Under the Romanian Fiscal Code, gains from the transfer of cryptocurrencies are taxed at 10% (income tax) on the net annual gain exceeding 600 RON per transaction. Gain is calculated as the difference between sale price and acquisition cost, plus related fees. The declaration is filed annually through the Single Declaration (form 212). For larger amounts or staking/yield farming, the tax regime can be more complex and requires specialized advice.
EU Regulation MiCA (Markets in Crypto-Assets, Reg. 2023/1114) applies in full from December 2024 and governs the issuance of crypto-assets, asset-referenced tokens, e-money tokens and crypto-asset service providers (CASPs). In Romania, the competent authority is ASF (Financial Supervisory Authority). Operators providing crypto services prior to MiCA benefit from a transitional regime but must obtain CASP authorization under the new framework.
A well-structured token project requires: a whitepaper compliant with MiCA requirements, a token sale agreement (SAFT or equivalent), platform terms and conditions, KYC/AML policy compliant with Law 129/2019, contracts with smart contract auditors, technology licensing agreements, exchange listing agreements and, depending on the legal qualification of the token, possibly a public offering prospectus. The qualification of each token (utility, security, asset-referenced) determines the entire contractual framework.
Yes, but the chances depend on several factors: identifying the perpetrators (blockchain analysis through chain analytics firms), the jurisdiction of the platform, the existence of insurance or guarantee funds, the possibility of freezing funds on centralized exchanges through international cooperation. Common actions include criminal complaint for fraud / money laundering, notification of regulated intermediaries, and civil action for recovery. Quick reaction within the first 24–72 hours is critical.
