Moral Damages in Road Traffic Accidents
Member of the Bucharest Bar
Following a road traffic accident, the damage suffered is not always purely financial. In many cases, the most serious consequences relate to pain, suffering, and personal loss. For such situations, the law allows the award of moral damages.
Moral damages are not granted automatically and do not have a predetermined value. They are awarded based on the real impact of the accident on the injured person or, where applicable, on the victim’s family.
What are moral damages
Moral damages represent compensation awarded for physical and psychological suffering caused by an accident. They do not cover direct financial losses, but rather the harm to physical integrity, emotional balance, and personal life.
In road traffic accident cases, moral damages are closely linked to the severity of the injuries or to the loss of a close family member.
Who pays the moral damages
The RCA insurer of the driver at fault pays the moral damages, within the limits set by Law 132/2017 on compulsory motor liability insurance. The driver at fault does not pay out of pocket as long as a valid RCA policy exists.
If the driver at fault was uninsured, or fled the scene and cannot be identified, compensation is claimed from the guarantee fund administered through the Romanian Motor Insurers' Bureau (BAAR). The victim is not left without redress.
Moral damages in cases of bodily injury
Where a road traffic accident results in bodily injury, moral damages may be awarded for:
- -physical pain;
- -psychological suffering;
- -functional limitations;
- -impact on personal and professional life;
- -a significant change in quality of life.
The more severe and long-lasting the consequences, the more carefully the court will assess the extent of the moral harm.
Moral damages in cases of death
When a road traffic accident results in the death of the victim, moral damages may be awarded to close family members for the loss suffered.
Depending on the circumstances, moral damages may be claimed by:
- -the spouse;
- -children;
- -parents;
- -other close persons, provided the emotional bond can be proven.
The value of moral damages in cases of death is not standardized. It is determined based on the relationship with the victim, the intensity of the suffering, and the specific circumstances of the accident.
How the value of moral damages is determined
The value of moral damages is not calculated using fixed formulas. Courts assess each case individually.
In practice, the following elements are taken into account:
- -the severity of the injuries or the occurrence of death;
- -the duration and intensity of the suffering;
- -the impact on personal and family life;
- -the existence of permanent consequences;
- -the relationship between the victim and the claimant.
The court aims to award fair and proportionate compensation, reflecting the actual moral harm suffered.
How you obtain moral damages, step by step
Before going to court, the law requires a preliminary stage with the insurer. You cannot sue the insurer directly without first filing a compensation claim and receiving a response, or no response at all. The process has three steps:
- filing the compensation claim with the RCA insurer, together with the medical records and the evidence of the loss;
- the insurer's response: from the date the claim is filed, it has 30 days either to make an offer or to reject the claim with reasons, under Art. 21 (1) and (2) of Law 132/2017;
- court action, where the insurer's offer is unjustified or the claim is rejected.
The largest awards are usually obtained in court, not from the insurer's first offer. That initial offer reflects the insurer's interest in paying as little as possible, not the real loss suffered by the victim.
How long do you have to act?
The right to claim moral damages is time-barred after three years, under Art. 2517 of the Civil Code. Once that term expires, the action can be rejected as time-barred, however well founded it is on the merits.
This is why the moment you contact a lawyer matters. The earlier you act, the easier the evidence is to put together, particularly the medical records.
Are moral damages taxable in Romania?
No. Moral damages awarded by a court are not taxable. They repair suffering rather than representing income, so the victim receives the full amount established, with no tax withheld. More on the tax treatment of compensation is available on our tax law page.
Common mistakes when claiming moral damages
In practice, many claims are affected by errors that may significantly reduce the compensation awarded.
The most common mistakes include:
- -accepting an insurer’s offer too quickly;
- -lack of relevant medical documentation;
- -underestimating psychological suffering;
- -superficial formulation of the claim.
Conclusion
Moral damages in road traffic accidents are not granted automatically and do not have a fixed value. They depend on the specific circumstances of the case, the evidence submitted, and the way the claim is supported.
Proper legal representation makes the difference between the amount offered by the insurer and the compensation obtained through an effective enforcement of legal rights.
Frequently asked questions
What are moral damages in a road traffic accident?
Moral damages are compensation for the physical and psychological suffering caused by an accident. They do not cover direct financial losses, but the harm to physical integrity, emotional balance, and personal life. Their value depends on the severity of the injuries or the loss of a close family member.
Who pays the moral damages, the driver at fault or the insurer?
The RCA insurer of the driver at fault pays, within the limits of Law 132/2017. The driver does not pay personally as long as the policy is valid. If there was no insurance, or the driver cannot be identified, the claim goes to the guarantee fund run through BAAR.
How is the value of moral damages determined?
The value of moral damages is not calculated using fixed formulas. The court assesses each case individually: the severity of the injuries, the duration and intensity of suffering, the impact on personal life, permanent consequences, and the relationship with the victim. The goal is fair, proportionate compensation.
Who can claim moral damages in case of death?
Moral damages in case of death are awarded to close family members: the spouse, children, and parents. Other close persons may claim compensation if they can prove an emotional bond with the victim. The amount is set case by case, based on the intensity of the suffering.
How long does the insurer have to answer a compensation claim?
Thirty days from the day you file the claim. In that time the insurer has to make an offer or reject the claim with reasons, under Art. 21 (1) and (2) of Law 132/2017. If the offer is unjustified or the claim is turned down, you can still obtain the compensation in court.
What mistakes reduce the moral damages awarded?
The most common mistakes are accepting the insurer's offer too quickly, lacking relevant medical documentation, underestimating psychological suffering, and framing the claim superficially. Each of these can significantly reduce the compensation obtained.
